Magarpatta monopoly and DLF CCI penalty

Hi:
We are residents of Magarpatta city Pune. We read news of DLF monoply case with CCI and wish to inform you similar practice adopted by our famous builder Satish Magar and his company- Magarpatta Township development Company, address: Magarapatta City, Pune, under patronage of a powerful union minister and DyCM & CM of Maharastra.
The flats here were developed and promoted as 'walk to work' concept and most of the flats (10000) are purchased by the software engineers of Amdocs, Mphasis, Patni employees, as commercial buildings are in same area.  I don't say-owned as ownership is still retained by the Magarpatta company cum Satish Magar by indulging in malpractices for his monopoly in this concept of 'walk to work'.
Monopoly: This was the novel concept and so people purchased flats - unknowingly knowing that they will not have ownership & freeedom of India, as it should be.
Malpractice:
1. He has tri- party flat sale agreement with he and his company being 2 parties - signed by a single person- his power of attorney.
2.. We don't have freedom to sell house. We have to seek permission from Magarpatta company and need to pay 80,000 as admin fee. Previous he used to take it all in cash. Now he issues receipt as admin fee.
 b) Besides this admin fee, he takes 2Lacs as enhanced maintenance fee- thus 3Lacs in each sale of the flat as admin fee.
3. Builder asks to take persmission & pay Rs 4000 per  day for use of club house- for any get together.
4. Builder asks to pay 10,000 per year and 2500 as registration fee for use of Gymn, to the builder- inspite of it being mentioned as amenity.
 While we are paying for gym and swimming pool usage, he is using 10Lacs per year to give it to Poonawala foundation as charity, from our maintenance money- without our consent.
5. On top of it, he forces every flat purchaser/ tenant to have builder issued id card @100 else his guards harass in entry to flats.
6. He doesn't allow the use the notice boards and tears of notices unless Rs 200 is paid for each notice.
7. He runs his commercial library in our club house.
8. He has posted 3 guards at city entrance who don't allow newspaper hawker and milk vendors inside and he charges 10,000 from each of the 4 of his designated hawkers- who recover  money from us- as service charge for paper delivery.His single designated Milk vendor charge 2-4 per liter over the MRP.[ When it was 26/- per liter, we paid 30/-]
9. Parking outside of our home or office is 10/- per vehicle by his own people. Any parking on road side or against his guard wish cause penalty of 500/-. 6 Parking in crowded Magarpatta city's market place are reserved for him & unused. If we park  there or on side of road, his guards lock the vehicle with big locks and extort 500 for release.
10. He didn't care to give possession of flats, on time for his monopoly and I got possession of flats after one year of date on agreement.
11. All basement parking is seeping which is detrimental to the buildings.
12.  For his monopoly and being president of PBAP and his good connection, he doesn't plan to give ownership to us and perhaps with a plan that on fall of the building, he will rebuild & reselll the flats.
13. He too sold the parking (1.5Lacs) against law and against SupremeCourt order and overcharged for MSEB connection for 60000 per flat for his monoploy and stronghold.
14. To top it all, he doesn't allow to use the lift for even a suitcase for even 11th floor resident. This is total harassment for his mononpoly. His guards switch off the lift or issue 1000/- penalty for use of lift for any baggage.
15. With his clout, he is forcing companies in the campus to ask for Magarpatta id card, for overseas travel, if they live here ! eg Amdocs.
16. Tata indicom installed intercom but builder asked Tata not to give intercom directory to us, making intercom installation useless for us.
17. He spends lakhs on his company foundation day with no details on expenditure of our maintenance money and still no entry if I don't have his issued id card.
Please look into the issue of flat ownership,freedom to sell, use lift, gym, control on our maintenance money of 100 crores, with stop on wastage of our maintenance money on annual 10 Lacs donations, when I am paying 56 for choked drainage  or Rs 2000 for allowing me to come out of house, in case of malfunctioning main door lock locks me in the house.

Railway Tatkal system- 421 Tatkal seats in Garib Rath- 50%Emergency travel

There is tatkal railway reservation which usurps as many as 50% seats besides 30% seats to Railway quota.
Please do away with 2 types of quota as both mean same- emergency travel.
Merge Tatkal and Railway emergency quota.
Or
As RB put, no W/L is confirmed as all canceled/quota release is given to Tatkal, you may cancel general quota. Have just Tatkal quota( 10 days prior booking).  2 days prior Tatkal booking creates unnecessary shortage and rush to counters.
Below shows that RB reserves 50%+30% for quota with 20% for general and earns handsomely for cancellation of his lot of W/L tickets as none get confirmed
Please stop this. Even I will not get ticket for 3 month later and have to rush to station 2 days prior to travel and hope to get ticket.

Indian Railway HO Quota on sale!

In same line with expose of Star news on Tatkal system in Indian Railways, ref train JP-Pune of 24/2/11, there was passenger Ved Prakash gupta- PNR-8538890734 who paid Rs 800 to get the HO quota seat! He got one under HO quota.

b. Its interesting to note that till last moment my WL was 7 in 3AC for Railway's hoarding. Details to show Indian Railways hoarding

i) (8+7) 15 seats were vacant in 3rd AC

ii) 28 seats from SL were upgraded to 3AC

iii) 17 general WL at chart time were cleared.

iv) 16+6WL Tatkal were cleared

In total you hoarded 82 seats- more than a coach if we consider there were no last minute cancellation.

Request & Suggest Indian Railways

a. to revert back to 'first come first served' basis with only 10% for your Indian Railway privilege as per tenet of PSU.
b. Investigate the corruption of allocating HO seats on payment basis under Railway quota for 400/-.
c. Investigate & stop the hoarding to extent of 70% in name of Tatkal and railway quota.

Many of us have the received our first bill on 16th April 2010 in total of 25000/-.
Please consider the following facts and advise the staff to issue the corrected bill from residents to tune of few crores!
a.       The type of property is defined as occupier and not flat? Why not? Whats the difference?
b.      We didn’t get the solar & vermicular discount of 10% inspite of PMC commissioner letter for Magarpatta issued in 2005?
c.       We didn’t get the discount of 40% of self occupied. And we are being suggested that we will get the rebate in next bill!
d.      We don’t have PMC water connection and are getting ground water mix from Magarpatta. You asked us to pay Rs90,000 for water tax from just 1 bldg! Please review! 25 Crore water yearly tax just from just one society? Are we really using water to extent of 250 crores worth water?
e.      We have internal sewerage disposal system so request you for waiver of sewer tax.
f.        We have got exorbitant bill to tune of Rs 10000 per flat ie 4L per bldg! People pay 2500/--4000/-in other areas!
Please look into the issues urgently so that we can deposit adjusted tax of previous 1.5 years and adjusted advance tax asap.

Magarpatta exploitation by Pune Municipality- Email to PMC Commissioner

This is in reference to exorbitant property tax bill of 850sq ft, new flats in Magarpatta city, to tune of Rs25,000 with Rs 15,000 arrear in first bill !
1.       This is historical moment that Pune municipality entertained request to pay first property tax  bill in installments, acknowledging it to be exorbitant for flat occupiers.

2.       Pune Prop Tax commissioner, Mr Vilas Kanade allowed First bill of 25000/- payment in installments. We should not have such high first bill, or otherwise, requiring installments.

3.       Arrear comes from unpaid bill, not in first bill. Illegal Arrear of 15000/- in first property tax bill from PMC Pune, should be taken off. No one has heard arrear in first bill.

4.      MOFA-Maharastra govt act, states that ownership is transferred to flat buyers as soon as 60% flats are sold so that one doesn’t pay tax, without being owner. But it seems, PMC devised a new term- ‘Occupier’ to support builder and work as builder’s organization than a government body. Please expunge this term, to protect Indian’s interest/rights and charge the tax from builder till society is formed /ownership is transferred to buyers.

5.       Taxation of Magarpatta flats is 10 times more than of houses worth crores, of my neighbors- including of owner and builder of so called Magarpatta township. In other words, there is no uniform tax applicable in same-Hadapsar Pune area. Details attached below from PMC website.
6.       Average metered water connection charge, PMC claimed as Rs 300. Our flats with 2-4 persons have 2400/- water tax against normal 300/-, where Magarpatta’s Commercial IT towers(eg O/1/20/01334005 ) with 1000 employees have lesser- Rs 2000/- water tax. Residential flats’ water tax more than commercial property having more carpet area is invalid & need correction.
7.       Details of taxation of Magarpatta commercial towers shows that only few floors are taxed and all 10 crore tax is due, while PMC is imposing penalty on us-without ownership.

vi) TOWER -6 : P/1/20/01334000  SATISH D.MAGAR (PAH)  SHRI. SATISH D.MAGAR (PAH)  S.NO.143 TO.147,MPTCC-2, CYBERCITY MAGARPATTA CITY HADAPSAR PUNE-28   is shown as owner of the tower. Tax should be from owner that occupier- term PMC devised.
vi) Tower 6: no details of tax of floor 5. Tax free?
8.        Tax commissioner told we are occupiers of flats and not owners. If Magarpatta Company is owner, PMC should not ask tax from us. So should be for renters of Magarpatta Commerical towers. Should we pay tax, when we are not owners but tenants on the premises? (If society is not formed under MOFA (stipulates society formation with 60% flat sale), as per PMC, the place belongs to builder. So owner is builder and tax should be from builder. If building falls, I will not get place to build flat again). Evident fact that we are not owner is that
I)                    We are not allowed to use lift for luggage and are forced to carry luggage, in hand/head or pay penalty to the Magarpatta company/builder of Rs 1000. Builder’s guard switches off lifts, if resisted.
II)                  Without Magarpatta issued id card of Rs 100, we are not allowed to enter Magarpatta road at night. Autos are forced to take detour to commercial buildings’ access gate- 1.5 km circuitous route.
III)                Even our servants have to seek permission to work with us, from Magarpatta company for annual fee of Rs 40- without any receipt. Else they are harassed or denied to enter.
IV)                Every resident in this area has to register with Magarpatta builder cum owner @Rs 100
V)                  Even taxi with renter IT companies have to pay 1000/- as one time registration charge with 100/- id card fees, to be allowed to run his taxi in Magarpatta.
VI)                 For sale permission for flats, we pay 3Lacs to Magarpatta company along with 10% service tax to government, besides stamp duty. Is it a service on which tax is required?
VII)              We can’t use any notice board of our bldg without fee & permission of Magarpatta Comp
VIII)            We pay for parking to Magarpatta company/builder, even if we park vehicle outside our house or office or our vehicles are locked for penalty of Rs 100-5000. Without payment of penalty of Rs 5000, they held a truck for 5 days under my bldg. [ As per Magarpatta company, here builder rules and govt rules don’t work here.]
IX)                Builder’s vehicle or its authorized vehicle –like CWG item sale item can stand all day but our vehicles are locked or shooed away even when we are standing to wait for somebody in front of its commercial tower.
X)                  We have signage for Magarpatta company& its advertisements and can’t for our bldgs.
XI)                We can’t use club house or gym, pool without permission & fee to the builder to tune of Rs 25000/-.  He imposes penalty of 5000/- by forfeiting deposit, he takes, to allow use of club house[besides Rs 4000 for use], at his whims.
XII)              He closes any road for his financial gain eg shootings, access of market for exclusive access to his hotel-‘Cocoon’ or at his whims like road access to Jasminium bldgs[ A wall has been erected].
XIII)            Magarpatta builder charges Rs40,000 from paper men for his and paperman’s monopoly & restrict  paper/milk man access to single vendor- his company shareholder.
XIV)            We paid 2-5Lacs with Rs 20-50,000 Stax to government, for civic maintenance to builder, with no accountability to builder who uses it, as per his will with no MOFA act applicable to him. We pay him for even a small work like drainage cleaning, fee with Service tax !
XV)              6 unused, manned Parking are reserved for builder cum owner of Magarpatta in busy market. If we try to park there, our vehicles are locked and penalty is imposed.
XVI)            Holi, our brotherhood cultivating festival, is prohibited near our flats and penalty is imposed if enjoyed. It is instructed to see celebrations by unknowns, at his field only.
XVII)          No roof access to us, to see moon on festival like Ramzan Eid or Karvachouth as per builder’s order.
XVIII)        Commercial service apartments in residential area, with impunity against residents’ wish, rented thru builder’s company- ULC. PMC waived off commercial tax charges as support.
9.       If PMC has to tax, get refunded the maintenance money and Stax. Why double taxation? Let PMC pick my garbage and mow the garden as for other Pune residents and collect the tax from us. Why tax for free when PMC allowed our builder to take heavy maintenance money with Stax.
It should not be that PMC and builder both have control over same land and both will charge for maintenance of civic amenities!
10.   PMC should not charge the tax from tenants of the property- based on sale agreement with no rights on property.
11.   For lack of water supply, PMC suggested to contact Magarpatta as it supplied water to them and not to us, then we shouldn’t pay water tax to PMC & that too more than larger commercial ones?
12.   PMC gives 10% rebate for solar panel and 40% rebate for self occupied house. There is no municipality/place in India, where property tax is Rs 10,000, after 50% discount of a 850sq residential flat or otherwise. Pune should not have such high taxation for Magarpatta flats.
13.   As per PMC commissioner statement in Indian Express, Magarpatta city is handling all civic activities, without any penny being spent by PMC, then we should not have 10 types of tax with such high bill. Gen tax for payment of PMC salary should be only tax applicable, if at all.
14.   PMC is giving discount of 40% on 1 component and not on total bill, as in other municipality. Correct this anomaly for reasonable tax bill.
15.   PMC commissioner refused to correct the bill for 10% discount for solar/water harvesting in area, which PMC commissioner has ordered in 2008 for Magarpatta flats. Please get this corrected.

 PMC is unreasonably, charging crores of tax from ordinary law-abiding occupiers- not owners. Instead it should have tax collection from owners of the property and @ same rate to all.
18.   PMC should have property no & tax collection from Magarpatta company’s PMS dept - commercial office to collect money for its Cable TV business, maintenance charges, club house charges, laundry room charges and cheques for NOC, collection of payment for flats’ sale.
19.   PMC should have property no & tax collection of Magarpatta’s commercial Gym and swimming pool, Deccan harvest restaurant, Yummy tummy restaurant. They should not be free from tax.
20.   PMC should have property no & tax collection of Magarpatta’s commercial  admin office in Magarpatta Pentagon tower? From there, it is controlling the Nanded commercial office too.
21.   PMC should have property no & tax collection of Magarpatta’s Cocoon Hotel in Magarpatta City.
22.   PMC should have property no & tax collection of Magarpatta’s commercial 2 laundry shops in each society @ rent of Rs 10,000 pm.  Eg Jasminium C1 –opp to lift, B Bldg, So in Grevillia, roystonea and so on.
23.   PMC should have property no & tax collection details of Magarpatta’s John Deere's tower earning lakhs of rental revenue for the owner cum builder.
24.   PMC should have property no & tax collection details of Magarpatta’s club houses used for commercial purposes. We pay Rs3000-4000 per use to Magarpatta company/builder.
25.   Magarpatta township has parking collection to tune of 15000 per day from employees, residents and equal amount of penalty charges. PMS should share its part legally as does police to support its illegal holding of vehicles.
26.   If we stay in Magarpatta builder owned property, we should not pay property tax and if its under purview of govt, its guards should not be at entry roads to stop me, papermen/milkmen to enter for Magarpatta builder’s monopoly and we paying parking charges, without PMC tender.  Magarpatta builder charges Rs40,000 from paper men for his and paperman monopoly.
27.   Magarpatta Company can lock/restrain our vehicles, restrict use of lifts and charge penalty to extent of Rs 5000/- from us/truck as it is owner, then tax to PMC should come from owner.
28.   Property tax rebate of 10% on 10,000 is 200/- and 2% penalty on 4000/- is also 200/-. That is unfair and illogical. PMC should take off the heavy penalty of 25% on adv tax and have correct, equal tax code.
29.   Before 25% penalty, recover property tax of commercial towers of Magarpatta pending for last 6 years- to tune of 10 crores.
30.   Is 25% penalty on advance tax justified when PMC is squandering tax money brazenly on marathon, Switzerland trip, study tours, BRTS against limit of 3Lacs ? No other municipality in India, has such draconian measure with heavy tax after waste of public money.
31.   Instead of 25% penalty, PMC should not sponsor Sahitya sammelan with 51 Lacs Rs 20 lakh for the Pune Festival in February and Rs 15 lakh cash for the Baisakhi Festival than its limit of 3Lac donation against the law.

33.   PMC may charge as tax for UNINOR/laburnum advertisement on all over Magarpatta road if its not Magarpatta private road. If its Magarpatta private property, take tax from owner.
34.   PMC takes rental for illegally sold parking, sold against MOFA & Supreme Court ruling, registered at govt office. Rental for sold property is again illegal that too by govt body-PMC! Stop rental or get the parking price of 1.5Lac refunded from builder cum owner of the property!

‘Blocked for’ doesn’t seem any valid name.
Considering above fact, I request you to     a.   recover the property tax from commercial properties and b.  from the owner- Magarpatta company who we paid heavily- 300 crores with 30 crores service tax to government, till MOFA act is implemented and we get ownership and with parity in taxation in area.
Without ownership, freedom to live peacefully, parity in tax, paying tax is tantamount to support our exploitation- by govt body and builder, in collusion.

You are all senior administrator. We got 1st bill of 25000/- bill this year. We paid 2-3 L per flat to Magarpatta too for maintenance ! Is it not double taxation? Why we should pay tax when other people in Pune pay lesser tax and still get PMC water and garbage collected by PMC but here we don't get PMC water and Magarpatta controls water(will give full day water cut(9-5) from Monday!) and Magarpatta collects garbage!

If there was no problem, we would not have approached you! We feel 10,000 is exorbitant tax when salary of some of the PMC employee might be 10000 itself.

ii) In wanawadi, 1700sq ft has tax of 4500 and we for 750sq feet will pay Rs 10000? You need to look into this gap. Just saying that property is new and so tax will be 5 times seems to be injustice to 1000s of residents.

iii) For 10% solar rebate,advising WO Hadapsar & looking for its recommendation even when we gave letter of PMC commissioner of 2008, seems to be your suggestion that we will not get corrected bill for last 3 years inspite of PMC sending us the consolidated one bill for 3 years!

iv) Please acknowledge that PMC has passed the 'Magarpatta city' act and acknowledged the maintenance fee of 2L( now they are charging 3L) ie nearly 1 crore per bldg collection for maintenance and so you should give all tax waiver to residents and should charge tax from Magarpatta company, if any. Asking the higher tax than other Pune residents is super double tax whammy.


Please review the taxation, considering hard earned money of public involved!
Either you cancel the city act and hence Magarpatta collection of maintenance money of 2-3L per flat and start collecting garbage and supply water to us or charge Magarpatta company the tax- whatever applicable!

Many of us have the received our first bill on 16th April 2010 in total of 25000/-.
Please consider the following facts and advise the staff to issue the corrected bill from residents to tune of few crores!
a.       The type of property is defined as occupier and not flat? Why not? Whats the difference?
b.      We didn’t get the solar & vermicular discount of 10% inspite of PMC commissioner letter for Magarpatta issued in 2005?
c.       We didn’t get the discount of 40% of self occupied. And we are being suggested that we will get the rebate in next bill!
d.      We don’t have PMC water connection and are getting ground water mix from Magarpatta. You asked us to pay Rs90,000 for water tax from just 1 bldg! Please review! 25 Crore water yearly tax just from just one society? Are we really using water to extent of 250 crores worth water?
e.      We have internal sewerage disposal system so request you for waiver of sewer tax.
f.        We have got exorbitant bill to tune of Rs 10000 per flat ie 4L per bldg! People pay 2500/--4000/-in other areas!
Please look into the issues urgently so that we can deposit adjusted tax of previous 1.5 years and adjusted advance tax asap.

Magarpatta flats ownership issues, problems

PMC (Pune Municipality)Tax commissioner told we are occupiers of flats and not owners even after paying 50 Lacs to builder of Magarpatta City .

Evident fact that we are not owner for the flats is that
I)  We can’t use club house or gym, pool without permission & fee to the builder to tune of Rs 25000/-.  He imposes penalty of 5000/- by forfeiting deposit, he takes, to allow use of club house[besides Rs 4000 for use], at his whims.
II) We are not allowed to use lift for luggage from 11th floor, and are forced to carry luggage, in hand/head or pay penalty to the Magarpatta company/builder of Rs 1000. Builder’s guard switches off lifts, if resisted.
III)   For sale permission for flats, we pay 3Lacs to Magarpatta company along with 10% service tax to government, besides stamp duty. Is it a service on which tax is required?
IV)  We paid 2-5Lacs with Rs 20-50,000 Service tax to government, for civic maintenance to builder, with no accountability to builder who uses it, as per his will with no MOFA act applicable to him. We pay him for even a small work like drainage cleaning, fee with Service tax !

V)  Without Magarpatta issued id card of Rs 100, we are not allowed to enter Magarpatta roads at night. Autos are forced to take detour to commercial buildings’ access gate- 1.5 km circuitous route.
VI)  Even our servants have to seek permission to work with us, from Magarpatta company for annual fee of Rs 40- without any receipt. Else they are harassed or denied to enter.
VII) Commercial Service apartments -HummingBirds- are running  in residential complex with govt support. Their property tax reduced from 1Lac to 10000 with influence of builder. Free access to Service apartments visitors, but we residents and our servants have to get the id card from builder.
VIII)    Every resident in this area has to register with Magarpatta builder cum owner @Rs 100
IX)    Even taxi with renter IT companies like Amdocs, Mphasis, Accenture,Patni have to pay 1000/- as one time registration charge with 100/- id card fees, to be allowed to run his taxi in Magarpatta.
                        X)  We can’t use any notice board of our bldg without fee & permission of Magarpatta Companay
XI) We pay for parking to Magarpatta company/builder, even if we park vehicle outside our house or office or our vehicles are locked for penalty of Rs 100-5000. Without payment of penalty of Rs 5000, they held a truck for 5 days under one of the bldg. [ As per Magarpatta company, here builder rules and govt rules don’t work here.]
XII)   Builder’s vehicle or its authorized vehicle –like CWG item sale item can stand all day but our vehicles are locked or shooed away even when we are standing to wait for somebody in front of its commercial tower.
XIII)   We have signage for Magarpatta company& its advertisements of  Uninor and can’t for our bldgs.
                       XIV)  He closes any road for his financial gain eg shootings, access of market for exclusive access to his hotel-‘Cocoon’ or at his whims like road access to Jasminium bldgs[ A wall has been erected].
XV) Magarpatta builder charges Rs40,000 from paper men for his and paperman’s monopoly & restrict  paper/milk man access to single vendor- his company shareholder.
                        XVI)  6 unused, manned Parking are reserved for builder cum owner of Magarpatta city in busy market. If we try to park there, our vehicles are locked and penalty is imposed.
XVII)  Holi, our brotherhood cultivating festival, is prohibited near our flats and penalty is imposed if enjoyed. It is instructed to see celebrations by unknowns, at his field only.
XVIII)   No roof access to us, to see moon on festival like Ramzan Eid or Karvachouth as per builder’s order.
XIX)     Commercial service apartments in residential area, with impunity against residents’ wish, rented thru builder’s company- ULC. PMC waived off commercial tax charges as support.
